From understanding how to register your business to getting the necessary permits, the process can feel overwhelming. That’s why I created this guide to walk you through the steps to start a legal business for photography in Hawaii, so you can focus on what you love most – capturing those special moments.

Step 1: Register Your Photography Business

Before you can start shooting professionally in Hawaii, it’s important to register your business legally. This process ensures that you are recognized as a legitimate business entity within the state! You can register your business online through the Hawaii Business Express. Here, you can easily file the necessary business registration documents, which typically include your business name and structure (such as LLC or sole proprietorship). In addition to registration, Hawaii Business Express allows you to purchase documents, manage your filings, and more.

Step 2: Get Business Insurance

Once you officially register your business, the next step is to get business insurance! Having the right insurance coverage not only protects you against potential financial losses, but it’s a requirement for obtaining permits to photograph legally in Hawaii. I personally use Next Insurance for my coverage, which is specifically tailored to meet the needs of small businesses, including photographers. They offer protection for your camera equipment, accidents, injuries, legal fees, and damaged vehicles.

Step 3: Contact the DLNR

With your business for photography registered and insurance in hand, it’s time to connect with the Department of Land and Natural Resources (DLNR) of Hawaii! This step is essential for obtaining permits that allow you to photograph in state parks, beaches, and other protected areas. When you email the DLNR, be sure to include:

1. Proof of your insurance

2. Your completed application.

3. A brief note stating that you are a legally registered business in Hawaii.

Step 4: Access Wiki Permits

After contacting the DLNR, you should receive login information from them for Wiki Permits. Here, you can purchase permits for every session you plan to shoot. Each permit costs $20 per event for a 2-hour time period on the date and time you provide in your application. Photographers that are being compensated for their services are required to have permits. This is because Hawaii defines it as a commercial activity. Overall, having the necessary permits helps you avoid any legal issues or potential fines! 

Step 5: Know Your Photoshoot Locations

I highly recommend familiarizing yourself with the various locations available for photography! The DLNR provides a helpful Beach Locations PDF that lists the places where you’re allowed to get a permit and legally do photography work. Also, taking the time to understand the laws surrounding these locations helps contribute positively to the preservation of Hawaii’s incredible landscapes and cultural significance. This awareness and respect help ensure these beautiful sites remain intact for future generations to enjoy.
